If you have encountered unlawful conduct within the organisation where you are employed, you are obliged to report it, and at the same time, you are protected by the Whistleblower Protection Act (ZZPri). The Act defines internal and external reporting channels. When filing a report, the whistleblower discloses information and provides evidence of violations that they have learned about within their work environment (current or past work environment).
Who is a whistleblower?
A natural person who reports or publicly discloses information on a violation obtained in their work environment.
How is a whistleblower protected?
The whistleblower is protected under the law, as ZZPri provides protective and supportive measures to prevent and eliminate retaliatory actions that could be taken against the whistleblower due to their report.
Important: Protection applies to reported violations that are ongoing, have occurred, or ceased less than two years ago. The trusted person handles the report anonymously and must not disclose the identity of the whistleblower unless the whistleblower explicitly wishes so. Judicial protection and temporary injunctions are ensured in cases of retaliation (Article 22 of ZZPri); free legal aid (Article 23 of ZZPri); unemployment compensation (Article 24 of ZZPri); psychological support (Article 25 of ZZPri).
How and to whom does the whistleblower report?
A report may be submitted to the trusted person anonymously or with contact details (so the trusted person can inform them about the progress of the case or request additional information). A written report may also be sent to the address: UL BF, CONFIDENTIAL!, Jamnikarjeva 101, with the name of the trusted person indicated.
